THIS AGREEMENT DESCRIBES THE TERMS AND CONDITIONS APPLICABLE TO YOUR (“SUBSCRIBER”) USE OF OUR SERVICES PROVIDED BY ELITE AUTO COLLISION REPAIR CENTER ("ELITE").
"SERVICES" IS DEFINED AS A TOOL TO DETERMINE THE AMOUNT OF A SUBSCRIBERS' COSMETIC OR COLLISION VEHICLE DAMAGE GENERATING AN ESTIMATE. BY SUBMITTING YOUR REPAIR INFORMATION, THE SUBSCRIBER ACKNOWLEDGES THAT THEY HAVE READ THIS AGREEMENT, UNDERSTANDS IT, AND AGREES TO BE BOUND BY IT.
BY ACCEPTING THESE TERMS, YOU CONFIRM THAT YOU ARE NOT A MINOR AND ARE CAPABLE OF ENTERING INTO A BINDING AGREEMENT, AND THAT YOU HAVE ACCURATELY COMPLETED THE INFORMATION WHICH YOU WILL BE SUBMITTING.
BY USING OUR ESTIMATION SERVICE, THE SUBSCRIBER ACKNOWLEDGES THAT ELITE'S REPAIR ESTIMATE IS A ONLINE EVALUATION AND THAT ELITE WILL NOT BE BOUND BY THIS SAID ESTIMATE. THEREFORE, IT IS YOUR SOLE RESPONSIBILITY TO NEGOTIATE THE TERMS FOR ANY WORK TO BE PERFORMED BY YOUR ELITE. YOU MAY WANT TO CONSULT WITH APPROPRIATE EXPERT ADVISORS TO ASSIST YOU IN AUTOMOTIVE REPAIRS, INCLUDING BUT NOT LIMITED TO YOUR INSURANCE COMPANY REGARDING YOUR POLICY COVERAGE, DEPARTMENT OF INSURANCE FOR YOUR PARTICULAR STATE, AND OTHER MATTERS.
ELITE MAY AT ITS SOLE DISCRETION AND WITHOUT NOTICE, ADD, OR REMOVE CERTAIN FEATURES OF THIS AGREEMENT OR CHANGE THE TERMS OF THIS AGREEMENT. SUCH CHANGES SHALL BE POSTED ON THE THIS WEBSITE AND THAT OF ITS MARKETING AGENTS.
YOU ACKNOWLEDGE AND AGREE THAT ELITE OFFERS A COLLISION ESTIMATE AND COSMETIC ESTIMATE FREE OF DIRECT CHARGE TO THE SUBSCRIBER AND THAT SUCH SERVICES ARE PROVIDED ON AN “AS IS” BASIS WITHOUT ANY RECOURSE WHATSOEVER. ELITE HEREBY MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE QUALITY OR ACCURACY OF THE ESTIMATE OR THE EXACTNESS OF ANY INFORMATION PROVIDED TO THE SUBSCRIBER. AS SUCH THE SUBSCRIBER EXPRESSLY AGREES THAT ANY USE OF INFORMATION PROVIDED BY ELITE IS FOR THE SUBSCRIBER'S PERSONAL USE AND THAT SUCH INFORMATION WILL BE ACTED ON BY THE SUBSCRIBERS, AT THE SUBSCRIBERS SOLE RISK.
ELITE WILL NOT BE LIABLE FOR DAMAGES OF ANY NATURE ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE OR ANY THIRD PARTY SERVICES OR USE THEREOF BY ANYONE ELSE FOR THE WORK PERFORMED OR OTHERWISE.
YOU AGREE TO INDEMNIFY AND HOLD ELITE, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING REASONABLE ATTORNEY'S FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF ANY MATTER UNDER THIS AGREEMENT OR OTHERWISE.
